REGISTRATION PROCEDURE:

1. Trademark search:

Firstly, one must select a trademark for his product. Make sure that the trademark doesn’t resemble or is identical to any other registered mark. You can do this by searching the trademark records registry. The search can either be done online or through the trademark office.

2. Trademark filing:

After the trademark search, the application for trademark registration can be filed with the Trademark Registrar.  The application for the registration of a trademark must be made in the prescribed manner along with the fee for trademark registration. A trademark application must contain the following information:

  • Logo or the Trademark
  • Name and address of the trademark owner
  • Classification or trademark class
  • Trademark used since the date
  • Description of the goods and services

3. Trademark application Allotment

Once the TM registration application is filed with the TM Registrar, a TM application allotment number will be provided to you within one or two working days. Typically, on obtaining a TM application allotment number, the owner can affix the TM symbol next to the logo.

4. Trademark Examination

The TM registration application will be allotted to a TM officer in the TM Registrar's office and the officer will then review the TM application for correctness and issue a TM examination report. The TM officer shall then allow for TM journal publication or object to the TM registration application.

If the TM registration application is objected to by the TM officer, the TM applicant has the right to appear before the TM officer and address the objections. If the TM officer is satisfied with the justifications of the applicant, the TM would be allowed for the TM journal publication, and if not then the TM applicant has the right to appeal the decision of the officer before the IPAB (Intellectual Property Appellate Board).

5. Trademark Journal Publication

When the TM registration application is accepted by the TM registrar, then the proposed TM is published in the TM journal. If there are no objections filed for the same within 90 days then the mark will be registered within 12 weeks.

6. Trademark Registration

If there are no objections or oppositions for the TM registration application, the TM manuscript, and TM registration certificate will be prepared and sent to the TM application. Once the TM registration certificate is issued, the TM is considered to be a registered TM of the owner and will be granted exclusive use of the mark.
