A trademark is usually only valid for ten years and after that needs renewal. At times the companies forget to renew it and to minimize this, the registrar sends a notice 6 months before the expiration of the trademark.

The renewal of a trademark can be done in two ways:

  1. You can apply renewal to change any sign or word in the already existing trademark or,
  2. You can apply otherwise without a change in the trademark.

The procedure is as follows:

  • Firstly a renewal application is made in the form TM-R. The application can be filed either by the registered owner of the TM or an agent authorized by him.
  • Filing a renewal application for a trademark gives your trademark a life for another 10 years, after which you need to renew it again.
  • After applying for renewal of TM, keep checking the status of your application periodically until it is processed by the registrar.
  • It then gets advertised in the Trademark Journal.

In case you forgot to renew your TM then you can apply for restoration under section 25(4) of the Trademark Act, 1999. This can be done through application and by paying the prescribed fee, however, this must be done within one year of the expiration of the TM.
